It was held in Complaint Number 366/2008 decided on dated 27th April 2010 Amjad Javed Vs. Dr. Asma Batool Awan  IN THE COURT OF SOHAIB AHMED RUMI DISTRICT & SESSIONS JUDGE/PRESIDING OFFICER DISTRICT CONSUMER COURT, GUJRANWALA JUDGMENT: Case of the complainant is that respondent Dr. Asma Batool is running private medical center known as Fatima Hospital at Hafizabad. Wife of the complainant Sughra Javed was admitted by the respondent in her hospital with labour pains. Due to mishandling by unqualified staff employed by the respondent, patient’s condition become serious as a result of which through major surgery a male baby was taken out of the womb who died sooner due to respondent’s carelessness and substandard service. In this case complainant and his family has to suffer immense loss of a male child in their family. Although such loss cannot be measured in material terms, however, this Court directs the respondent to pay Rs.10,000,00/- as compensation to the complainant inclusive of the litigation charges. Besides, Dr. Asma Batool is also burdened the fine of Rs.2,000,00/- to be deposited in the state treasury within 30 days of the passing of this judgment with a warning to be careful in all respect while dealing with her professional life in future.

It was held in complaint of Ahmed Nawaz VS Jadoon & Company Import and Export Customs Clearing and Shipping Agent decided on dated 10 November 2012 IN THE COURT OF DISTRICT AND SESSION JUDGE/:PRESIDING OFFICER DISTRICT COURT, LAHORE ORDER A consumer court has directed the Jadoon & Company Import and Export Customs Clearing and Shipping Agent to pay Rs40,000 as damages to the petitioner for not delivering a parcel to the UK. Petitioner Ahmed Nawaz submitted that he had sent a parcel containing eight men’s suits valued at Rs20,000 to the UK though the said company. He said that the respondent, Wahab Khan Jadoon, had assured him that the parcel would be delivered on time, but it was not. He said when he asked the respondent why the parcel had not been delivered, he made various excuses. He sought Rs200,000 in damages from the company. The respondent had submitted a written statement at an earlier hearing in which he contended that the parcel was delivered on time to the given address. However, no one appeared before the court on the respondent’s behalf at subsequent hearings. The court proceeded with the case ex-parte. The judge directed the respondent to compensate the petitioner for the cost of the suits and another Rs 20,000 as damages.

In the compliant of  Mian Zulqarnain VS Aftab Alam Chishti, owner of Dee Jays Designer. In this Case Petitioner Mian Zulqarnain Filed a Complaint in the Court and told that court that on February 11 he gave cloth to Aftab Alam Chishti, owner of Dee Jays Designer to stitch a two-piece suit. He said that he had instructed Chishti to stitch the suit in the three-button style. February 18 was set as the date of delivery of the suit, he said. The petitioner said that on February 18, when he went to pick up his suit, he found out that the suit had been stitched in the two-button style. He added that the suit was also not the right size. The petitioner said that the respondent assured him that he would have all the defects corrected and the suit would be ready in three days’ time. However, the petitioner said, the suit was not ready in three days and the date of delivery kept moving forward till the respondent on March 16 refused to remove the defects. Zulqarnain sued the respondent and asked the court to direct Chishti to pay him Rs4,000 for the price of the cloth, Rs15,000 as damages and Rs15,000 as legal expenses. On an earlier date, the respondent had appeared in court and said he would submit a written reply at next hearing. However, the respondent was absent from court and the court moved ex-parte on the matter. The judge passed an order on Monday directing the respondent to pay Rs 4,000, the price of the cloth and Rs 5,000 in compensation and legal expenses.
