SOME CONSUMER CASES AT PRODUCT PRODUCERS:

It was held in Complaint No 25/09 Sultan Mehmood V/s Motorcycle Company decided on dated 22 February 2011 in the Court of Mr. Muhammad Khalid Nawaz District & Sessions Judge/ Presiding Officer District Consumer Court Lahore. Complainant seeks decree for compensation and damages against the respondent on account of the faulty service regarding complainant bike No LEW-07-7725 which was purchased from the respondent soon after the purchase of the said bike it was found that the fuel tank is leakage. The petitioner submitted a claim bearing No. 0636 and after few days its shocks were broken down and again a claim was submitted to the manufacturer concern through dealer despite request made by the petitioner the respondent did not accept the genuine request of the complainant, legal notice was served upon the respondent to fulfill their contractual obligation but they remained adamant .Hence this petition filled by the complainant. The petition was instituted dated on 31-01-09 the respondent absented from the court and ex-parte proceedings were initiated against the respondent. The petitioner submitted affidavit on 01-04-10 .The respondent moved an application for setting aside ex-parte proceedings the learned predecessor of this Court while passing the order on the application for setting aside ex-parte proceedings accepted the application with cost of Rs. 2000/- which was not paid and finally on 09-02-11 again proceeded against ex-parte which is sufficient and shows contention of the respondent. This court keeping in view the petitioner’s version duly corroborated with contents of the petition, accepted the version of the complainant the claim of the petitioner is decreed in sum of Rs. 12,000/- along with the expenses incurred and claim in sum of Rs. 20,000/- as damages.

It was held in Complaint Number 209/10 Riaz ul Haq V/s Starlet Flagship, New Anarkali, Lahore decided on dated 17 January 2011 in the Court of Ijaz Ali District & Sessions Judge/ Presiding Officer District Consumer Court Lahore. Petitioner purchased shoes from the respondent on 07-01-10 against the payment of Rs. 1395/- after few days the soul of the shoe ruptured and shoe was de-shaped. During the cross examination the shoe was presented before the Court and it turned out to be defective. Court passed an Ex Parte Order. Ex-parte arguments heard and available record perused. The petitioner Riaz-ul-Haq himself appeared as PW-1 his affidavit tendered as Ex-P/1, purchase receipt Ex-P/2, legal notice Ex-P/3, dispatch receipt Ex-P/4, legal notice dated 20-04-10 Ex-P/5 and its dispatch receipt Ex-P/6. There is no rebuttal of the claim of the petitioner. Ex-P/2 the purchase receipt is very material showing the purchase of the shoe for the price of Rs. 1395/-.Therefore, the claim is decided in the way that respondent shall pay Rs. 1395/-(Subject to return of shoe) alongwith Rs. 5000/- as mental torture to the petitioner with no order as to cost.
